Critical thinking, thought around why punishment mitigation happens has potential for useful.
If there is a law that clearly states you cannot do ActionA. Then if you do ActionA, you might be punished. Clarity of laws, clear ground established factors into what people do and what people do not do, what is punished and what is not punished.
Punishment has potential to lead to Pain. Pain might be set to ideal value sometimes (which I don’t think is all good, should, or would), yet pain killers exist for a reason. Punishment generates Pain (sometimes), sometimes the two are synonymous, and Pain is diminished, reduced, and seen as less valuable to turn up for a reason. One reason is turning up pain or punishment on others is likely to turn it up on self, thus wiser to divest in advance. Punishment and Pain are both not all time cost free – wasted time and a society with reduced throughput as the result is less than ideal value established and delivered, injustice that might be worthy of punishment on its own merits.
A society that punishes less, has less than ideal capacity to punish at times is consequential, known might lead to better choices by all parties. It is hard to ideal, does not equate to hard to ideal is free of problems.
Pain receptors are important, people stop touching a hot stove because they feel pain – if they were on heavy pain killers they might not be able to tell before significant damage was done. We reduce pain and punishment in society for good reasons, because people in general are less than ideal sin out, less than ideal profit out, less than ideal oppression out, less than ideal reduced oppression in – less pain and punishment factors into peace, and peace is both desirable and useful. Punishment might lead to perception of human rights abuses, cost to litigate is not always desirable. Punishment not always free of pain for the punisher, free of time costs for the punisher, and time costs are valuable for both parties.
Clarity of laws equates to clear laws are more likely to be punished by authority. Iffy laws might be more likely to be punished by vigilante justice, or by reducing support, profit (things generally considered as a requirement by the Golden Rule – yet Golden Rule not always set to a requirement). Iffy ground is not usually synonymous with a strong brand, and strong brands have potential to stand through the storm at times when others do not – I agree this feels less fair, just how it is I least from my perspective. Gray area that is further from crossing the line might be more defendable through human laws – though human laws, legalism, and accounting set to ideal value by God seems unwise. This is all the perspective from someone that is not a lawyer.
Punishment and Pain are not always free from Power Struggles, Control, and High Ground. There are good reasons to divest in advance. Also potential for sexual implications – just because someone in Authority doesn’t mean punishment or pain that way does not equate to it might not amplify in the mind that way, potential for generation of less-than-ideal relationships.
A society that does not punish often might not be very familiar with the process, might be punishing in not fully appreciated ways (A-ed may let potential for not all theft out, theft is both wrong and punishing, owe is iffed ground which does not always make clarity ideal), and also might punish too much or too little (not very familiar with range) at least that is my opinion from someone that is not in the justice system, and not a lawyer.
I am saying in the previous paragraph, or at least trying to say The Justice system might appear more stable and just than it is, there is good reasons to turn its image up as stable and just, yet in practice might deliver less than ideally and that factors into potential for greater levels of risk, greater levels of risk in people going to parties, drinking at bars, taking drugs, and caught on camera. The system will protect you might be less than ideal protection, less than ideal risk mitigation invested in.
God is in the mix, don’t worry trust in God with less-than-ideal momentum for drinking trains of logic mix less than ideally. Combined with perception of reduced risk might lead to less-than-ideal results. Others might have likely do have better results than self at times. All said my case is unique, different – might be an outlier for both higher levels and lower levels is hard to fully appreciate 2001-2024 World Events a reminder World is less than ideal sin and oppression out, easy to paint choice as ideally deterministic. 1 person out of 8 billion plus people really enough of a statistic to claim grounds on anything?
